STRABAG takes another important step towards definitively resolving major construction industry cartel case through settlement in modification proceedings

STRABAG AG today, by means of a settlement, brought to a legally binding close the modification proceedings initiated by the Federal Competition Authority seeking judicial review of the final fine decision of 21 October 2021 for a EUR 45.37 million penalty.

With this agreement, STRABAG is taking a further important step towards definitively resolving the major construction industry cartel case.

Following a thorough assessment of the factual and legal situation, the company decided to enter into this settlement by accepting a EUR 100.63 million increase of the fine. This avoids a further lengthy court procedure and brings to a close the cartel proceedings that began with searches carried out at numerous construction companies in the spring of 2017 to investigate alleged cartel violations in the period from 2002 to 2017. Despite the increase in the fine, STRABAG is maintaining its current earnings guidance for 2025 and 2026.

Notwithstanding the concessions made as part of the settlement and loss of leniency-for-testimony status, the fact remains that STRABAG AG cooperated extensively with the Federal Competition Authority and made a significant contribution to clarifying the facts of the case.

In addition, STRABAG has since worked intensely on the further development of its Business Compliance System and is now the first Austrian company operating internationally to obtain group-wide certification under ISO 37001 and ISO 37301.
